GDPR is addressed concretely, through a dedicated compliance portal at trust.insighto.ai run on ComplyDog, which states outright that Insighto.ai is GDPR-compliant. It publishes a checklist marked complete across lawful basis, data security, governance and privacy rights, an online data-request form, and a named security contact: Mukesh Kumar Yadav, IT Security Manager, reachable at gdpr@insighto.ai. Access, rectification, erasure, restriction, portability, objection and automated-decision rights are each covered, with a response window of roughly one month, and breach notification promised to the authority within 72 hours. A DPA is accepted automatically with the terms, no separate signature needed. Two gaps stand out: no Article 27 EU representative is named, and the portal still presents the EU-US Privacy Shield as a valid transfer safeguard, six years after its invalidation.
Who owns the data?
The compliance portal states plainly that customers own and control everything they collect, and that any retention period is set by the customer's own policy or legal duty, not by the vendor. Internal access is restricted to qualified staff with a specific need, typically a support request you have raised yourself. Against that, section 5 of the terms grants the publisher a worldwide, unrestricted and unpaid licence over anything you submit, framed as necessary to deliver the service. Section 11 lets either side end the relationship at any moment: you can close your account whenever you wish, and the publisher may terminate access with or without notice.
Reuse rights
The privacy policy says data is used to personalise the experience, answer queries, improve the service, send updates you can unsubscribe from, and feed analytics. It rules out selling personal information to advertisers, and states that end-user personal data is not shared with any third-party service, AI models included. The terms of service tell a different story: section 6 says collected personal data may be used to train and improve the chatbot, including to understand user preferences and behaviour, while section 4 confirms that OpenAI backend layers are involved. The compliance portal sides with the privacy policy, invoking Article 28 to promise processing strictly on the customer's instructions and no third-party transfer without consent. Nothing on the site resolves this contradiction, and no opt-out from training is documented. The subprocessor list resolves the ambiguity only partly by naming Azure, alongside Google, Google Analytics, Facebook, HubSpot, OpenAI LLC, ElevenLabs, Stripe and an optional Partnero, all located in the United States. The accreditations quoted, ISO 27001, SOC 1 and SOC 2, PCI Level 1, FISMA Moderate and Sarbanes-Oxley, belong to the data centre provider rather than to the vendor.
