Terms of Use (CGU) – Guidaio

These Terms of Use set out the conditions for accessing and using the Guidaio website (hereinafter the "Site") as well as the rights and obligations of users. Use of the Site constitutes full and unreserved acceptance of these Terms of Use. If you do not agree to these terms, you should not use the Site. The Site's publisher, Powerlab S.à r.l. (hereinafter the "Publisher" or the "Company"), reserves the right to amend these Terms at any time without notice. Users are responsible for regularly reviewing the most recent online version.

Article 1: Definitions

Site: the website accessible at www.guidaio.com and all of its pages.

Publisher: Powerlab S.à r.l., publisher and owner of the Site.

User (or Visitor): any natural or legal person who accesses the Site and views its content.

Services: the features offered by Guidaio, in particular a list of artificial intelligence (AI) tools organized by categories and professions, with descriptions and external links.

Article 2: Overview of the Site and Service

Guidaio is a free and independent directory of artificial intelligence tools, organized by categories and professional fields. The Site provides Users with a catalogue of AI tools selected by the Publisher for their relevance and quality.

Listing on Guidaio is free for the AI companies or services included, and no payment is required to appear on the Site. The position or ranking of listed tools is not influenced by any remuneration, ensuring an impartial presentation of resources.

Users cannot directly publish content on Guidaio. The Site has no public comment area or user contribution module. Adding a new AI tool is performed solely by the Publisher, following prior review and assessment of the tool (including its features, reliability and usefulness). The Publisher may refuse or remove a listing at any time, in particular if it no longer meets the Site's criteria or breaches laws and regulations.

Content on Guidaio (descriptions, information, guides, etc.) is provided for information purposes only and does not constitute professional, financial or legal advice. While the Publisher strives to provide up-to-date and accurate information, it does not guarantee completeness or absolute accuracy. Users should verify the relevance of any information before relying on it.

Article 3: Access to the Site

The Site is accessible free of charge to any User with an internet connection. All costs related to access (hardware, internet subscription, etc.) are borne exclusively by the User, who is responsible for the proper functioning of their equipment and their internet access and acknowledges the characteristics and limits of the internet.

Access to Guidaio is, in principle, available 24/7. However, the Publisher may suspend access without notice or compensation for technical maintenance, updates or in cases of force majeure. The Publisher uses reasonable means to ensure quality access but is not bound by an obligation of result. No liability may be incurred in the event of temporary or prolonged unavailability, internet or server malfunctions, or any event beyond the Publisher's reasonable control that prevents or degrades access.

The Publisher may deny access to any User who fails to comply with these Terms (fraud attempts, unlawful activities, infringement of the Publisher's or third parties' rights, etc.), unilaterally and without prior notice.

Article 4: User Conduct

By using Guidaio, the User agrees to act lawfully and in accordance with these Terms. In particular, the User must not:

  • Disrupt or attempt to disrupt the normal operation of the Site by any means (e.g., introducing viruses, attempting overloads, hacking). Users must take appropriate measures to protect their own equipment and data, including up-to-date antivirus and firewall protection.
  • Use the Site or its content for illegal or fraudulent purposes or in a manner that infringes third-party rights, public order or morality.
  • Attempt to access unauthorized sections of the Site, circumvent security measures, or carry out large-scale extraction of Site data (e.g., unauthorized web scraping).
  • Reproduce, copy or reuse the Site's content (texts, images, descriptions, database, etc.) for commercial or distribution purposes without the Publisher's prior written authorization. Strictly personal, private and non-commercial use is permitted, provided the content is not altered and intellectual property rights are respected (see Article 5).

Generally, Users must use Guidaio diligently, fairly, and in compliance with applicable laws. In the event of a breach, the Publisher may take appropriate measures to stop the behavior in question, including suspending or blocking access, without prejudice to possible legal action.

Article 5: Intellectual Property

The Guidaio Site as a whole and all its components (texts, illustrations, graphics, logos, layouts, databases, and any other original element) are protected by intellectual property law. Unless expressly stated otherwise, these contents are the exclusive property of the Publisher or used with the authorization of the relevant rightsholders.

All copyrights, trademarks and other proprietary rights on the Site and its elements are reserved. "Guidaio" is a protected trade name. The names and logos of AI tools referenced on the Site belong to their respective owners and may be protected trademarks; their use on Guidaio is solely to identify and describe the services concerned and does not grant any rights in those marks.

Any reproduction, representation, distribution or redistribution of all or part of the Site's content for commercial or advertising purposes, in any medium, without the Publisher's prior written consent, is strictly prohibited. The Publisher reserves the right to take appropriate, including legal, action in the event of infringement, and to remove without notice any unlawful content that infringes its rights or those of third parties.

The Publisher authorizes only short quotations from Site content for information or review purposes, provided the source is clearly identified (e.g., a link to the relevant Guidaio page) and the meaning is not distorted. Creating hyperlinks to the Guidaio Site (including deep links) is permitted, provided such links are not placed in a defamatory, misleading or unlawful context. Conversely, any framing or in-line linking integration of the Site without authorization is prohibited.

Article 6: Limitations of Liability

6.1. Informational content – no warranty

The Publisher endeavors to provide content that is as accurate and up-to-date as possible, including by regular monitoring and verification of information about each referenced AI tool. Nevertheless, it cannot guarantee that all information on the Site is free of errors or omissions or is continually updated. Content is general and indicative. Users are responsible for verifying relevance and accuracy before making decisions.

Accordingly, Users bear full responsibility for their use of information and content on Guidaio. The Publisher is subject to an obligation of means (best efforts), not of result, as regards quality and accuracy. The Publisher shall not be liable for any error, omission, outdated or inaccurate information, nor for any direct or indirect, material or immaterial damage that may result from use (or misinterpretation) of the Site's information and services. Information about AI tools does not constitute endorsement or a guarantee of performance or fitness for a particular purpose. Users remain solely responsible for choosing whether to use any referenced tool and should review the third-party service's own terms before subscribing.

6.2. External links and third‑party services

Guidaio contains hyperlinks to third‑party websites (including official sites or platforms of referenced AI tools). These links are provided solely for convenience. Any interaction with third‑party sites occurs outside Guidaio and under the User's sole responsibility. The Publisher has no control over the content, offers, policies or practices of external sites and disclaims any responsibility for (i) content, ads, products, services or other information on third‑party websites, and (ii) any damage or loss resulting from consulting or using third‑party services via a link from Guidaio. Any dispute relating to a transaction or contractual relationship between a User and a referenced AI service must be resolved directly between them; the Publisher is not a party to such contracts. Users are encouraged to report serious issues with a referenced service so the Publisher may consider appropriate action (e.g., removal after verification).

6.3. Technical liability limitation

Users acknowledge the characteristics and limits of the internet, including the heterogeneous infrastructures on which data transfers rely. The Publisher does not warrant that the Site will be free from anomalies, errors or bugs, or that such issues can be corrected. Despite security precautions, Guidaio cannot guarantee complete protection against viruses, intrusions or other IT risks. Users should take appropriate measures to protect their data and software.

To the extent permitted by applicable law, the Publisher shall not be liable for direct or indirect damages related to use of the Site, its unavailability or any malfunction, including (without limitation) damage to Users' computer systems, data loss, lost profits, loss of chance, or any commercial harm. The Publisher is not liable in cases of force majeure or events beyond its control that prevent the Site from functioning properly or the performance of these Terms (e.g., natural disasters, third‑party failures, widespread power outages, labor disputes, government interventions).

Article 7: Affiliate links and commercial partnerships

Financial transparency. Guidaio participates in affiliate programs with certain referenced AI services. When a User clicks an affiliate link on our Site and then performs an eligible action on the partner's site (such as a paid signup or purchase), the Publisher may receive a commission. This commission is paid by the partner, with no additional cost to the User.

These affiliate relationships do not influence the Site's editorial policy. Selection and presentation of AI tools on Guidaio are made independently, based on merit and objective criteria (relevance, usefulness, observed quality), and not on the existence of an affiliate program. Listing on Guidaio is not a paid advertising service; it is free and impartial.

Where applicable, we indicate when a link is an affiliate link (through an explicit notice or symbol). By using these links, Users support the Site's operation. The Publisher does not receive personally identifying data through affiliate programs—only aggregated or anonymized reports (e.g., number of clicks or sales). No personal information about users who clicked an affiliate link is transmitted to Guidaio.

The Publisher complies with applicable transparency and fairness obligations for online platform operators. When a User reaches a partner's site via Guidaio, they retain all legal consumer rights as applicable (right of withdrawal, pre-contractual information, legal warranties, etc.), which the partner must provide under applicable law. As Guidaio is not a party to transactions on third‑party sites, the User must refer to the third‑party site's terms for rights and remedies.

Article 8: Personal Data Protection and Cookies

Privacy. Guidaio is committed to respecting Users' privacy and protecting personal data in compliance with applicable regulations, including Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and Luxembourg data protection law.

Data collected. Accessing and browsing Guidaio does not require registration and the Site generally does not collect personally identifiable data (no registration or comment forms, no request for email addresses during simple visits). No social media features or intrusive audience measurement tools are deployed. Only purely technical, non-directly identifying data may be collected automatically while browsing: e.g., the User's IP address (stored in server logs in the usual way), browser type, access times, etc. Trackers (cookies or similar technologies) may be used, with the User's consent, to ensure the proper functioning of affiliate links or other Site features. These affiliate cookies enable pseudonymous tracking that a User was referred from Guidaio to a partner site. Users can refuse these optional cookies via the consent banner on the first visit; refusal will not block access to the Site but may prevent proper tracking of some affiliate conversions (which does not affect the User but may deprive the Site of ancillary revenue).

Use of data. The limited technical data collected are used only for anonymous traffic statistics and Site security (server logs), and potentially for affiliate program operation as described above. No personal data are sold or disclosed to third parties for marketing. The Publisher likewise does not receive personally identifiable data from affiliate partners about Users who clicked sponsored links. If a User chooses to contact the Publisher (e.g., via the email address in the Legal Notice or any contact form), the information provided (such as the email address and the content of the request) is used solely to process and respond to the inquiry and is kept confidential for as long as necessary in accordance with the GDPR.

User rights. Under the GDPR and applicable law, Users have rights of access, rectification, erasure and portability of their personal data, and the right to object to or request restriction of processing, where applicable. Given the very limited volume of personal data collected by Guidaio, the Publisher may not hold any identifiable information about a given User beyond temporary technical logs. For any question relating to personal data or to exercise your rights, contact the Publisher using the details in the Legal Notice. The Publisher will respond within statutory time limits.

Article 9: Amendments to the Terms

These Terms of Use may be amended or updated at any time by the Publisher, in particular if the Site's features or legislation evolve, or for any other necessary reason. Changes take effect upon publication online unless stated otherwise. Users should check for updates regularly. The Publisher may inform Users of major changes by means of a notice on the Site, but this does not replace Users' responsibility to review the Terms. Continued use of the Site after changes constitutes acceptance. If a User does not accept the new terms, they must stop using the Site.

Article 10: Governing Law and Jurisdiction

These Terms are governed by Luxembourg law. The Site is hosted and administered from Luxembourg and the Publisher is a Luxembourg company; accordingly, the substantive and procedural rules of the Grand Duchy of Luxembourg apply to the interpretation, validity and performance of these Terms. In the event of a dispute related to use of the Site or interpretation of the Terms, Users are invited to contact the Publisher to seek an amicable resolution. Failing an amicable resolution within a reasonable time, any dispute shall be submitted to the competent courts of the district of Luxembourg, to which the parties confer exclusive jurisdiction, subject to any mandatory legal provisions to the contrary (notably consumer protection rules).

Article 11: Miscellaneous

If any clause of these Terms is declared null, illegal or unenforceable under a law or court decision, it shall be deemed unwritten without affecting the validity of the remaining provisions, which will retain their full force and effect. The Publisher may replace any invalidated clause with a legally valid provision that best reflects the original intent.

The fact that the Publisher does not invoke any provision of these Terms at a given time shall not be interpreted as a waiver of the right to invoke it later. Likewise, the absence of action regarding a breach by a User does not constitute acceptance of that breach and does not prevent the Publisher from acting for the same cause in the future.

For any question about these Terms or to report unlawful content or use, Users may contact the Publisher using the details in the Legal Notice. The Publisher will endeavor to handle any claims as soon as possible.

Last update of the Terms: April 2026. These Terms cancel and replace previous versions.
