GDPR overview
Implementation is genuine but uneven. The vendor is established in Germany, so the GDPR applies directly and no Article 27 representative is required. The privacy policy names the controller with a postal address, telephone number and email, enumerates the data subject rights article by article (15, 16, 17, 18, 20, 21), states a legal basis for each processing operation, discloses pseudonymous profiling through Google Analytics, and publishes a named list of six processors with their full addresses. Marketing reinforces this with a GDPR-friendly claim in the hero and a GDPR-ready (German) badge. Three weaknesses are factual: transfers to the United States are still justified by the EU-US Privacy Shield, invalidated in July 2020; no Data Protection Officer is named; and no customer-facing DPA is published.
Who owns the data?
The generated code belongs to the customer: Chattee states it is 100% yours, exportable in full at any time, standard and free of proprietary dependencies, on all three paid tiers. Processed data is a separate matter. Under § 4.2 of the terms of use, the customer grants Anwendo GmbH a non-exclusive right to analyse processed data, including usage statistics, use it in existing and new product development, and aggregate and incorporate it in anonymised form into machine-learning-based products. No opt-out is documented. Reuse rights
Yes, without asking permission. The customer may export the complete source code at any time — frontend, backend, database schemas and deployment configurations — then run it on their own servers, hand it to an internal team or keep building on it. The code is described as standard, independently runnable and free of proprietary dependencies, and the vendor confirms it survives Chattee itself shutting down. Agencies are explicitly allowed to resell the result: white-label delivery under the client's own brand, with full code handoff and custom domains. Two limits apply. Code export is a paid-tier feature, and § 8.1 of the terms restricts use of the platform to the customer's own images and texts, or to third-party material for which written permission has been obtained.
