GDPR overview
GDPR is handled contractually rather than merely mentioned. The terms define Applicable Laws as including the EU GDPR, the UK GDPR, Swiss law, the CCPA, the TCPA and the CAN-SPAM Act, and a Data Processing Agreement is incorporated into the contract as Exhibit A, so personal data is processed under it by default. The security page states that operations align with GDPR retention protocols and that DPAs are maintained for all EU-based customers, alongside SOC 2 Type II and CASA Tier 3 certifications and penetration testing. A data protection officer is reachable at dpo@11x.io, and privacy requests go to privacy@11x.ai. Who owns the data?
The terms give the customer exclusive ownership of its Customer Data and Performance Data, while 11x owns the service, the documentation and the related intellectual property. 11x takes only limited licenses: using Customer Data to provide, maintain and improve the service, and aggregating de-identified Performance Data for its own marketing without naming the customer. It contractually commits never to train AI or machine learning models on Customer Data. Feedback you send is licensed to 11x worldwide, irrevocably and free of charge. Subprocessors, including its hosting providers, may be involved, and 11x remains responsible for them. Separately, 11x builds its own B2B contact database and may infer business email addresses it does not hold.
Reuse rights
Customer Data and Performance Data belong to the customer under section 3.1, so there is no permission to ask before reusing them elsewhere — subject to section 7.2, in which the customer warrants that it holds all rights over that data and every consent needed to contact the individuals in it for marketing. The right to use the service itself is narrower: a non-exclusive, non-transferable and non-sublicensable license, for internal use only, within the scope of the Order Form and the documentation. Section 2.2 adds explicit use restrictions, and any breach of that section counts as a material breach that 11x may terminate immediately at its sole discretion. On termination, the privacy policy says 11x gives the customer access to everything stored for it so that it can be exported, after which 11x may delete it; confidential information is returned or destroyed within seven days, routine backups and archives excepted. Traffic is encrypted with TLS in transit, and data at rest with AES-256 in AWS RDS. The architecture is described as fault-tolerant, with clustered databases and containerized applications that scale dynamically. No EU hosting region is offered or even mentioned, and the privacy policy is explicit that information collected from people outside the United States may be transferred to, stored and processed in the United States. Contractually, the agreement is governed by California law, with exclusive jurisdiction in San Francisco County. Subprocessors exist — the security page mentions secure subprocessors handling connections to Salesforce and other sales platforms — but no list is published, and the trust.11x.ai portal returned HTTP 403, so its contents could not be verified.
