GDPR overview
Nero AG publishes a full German privacy policy which states expressly that personal data is collected and processed in accordance with applicable data protection law, in particular the GDPR. It names the controller under Article 4(7) — Nero AG, Rüppurrer Strasse, Karlsruhe — documents the rights of access, rectification, erasure, restriction, portability, objection and complaint to a supervisory authority, and claims technical and organisational measures aligned with Article 32. Processors are contractually bound to data protection law. No data protection officer is named, and no Article 27 representative applies since the controller is established in Germany. Two reservations temper this: the policy still refers to the EU-US Privacy Shield, invalidated in 2020, and it was written for the group's desktop software rather than for the AI services, whose own commitments sit in the Nero AI terms instead.
Who owns the data?
Nero AG owns the copyright on the logos, technologies, text, images and graphics used in its online services (Terms §4). What you produce is treated separately: media edited or created with Nero AI may be used both non-commercially and commercially (§2), and you must hold the rights to whatever you upload (§10). Two limits apply. Output from licensed third-party AI models may not be handed to others inside your own hosted service or API without Nero's written consent (§14), and Nero may embed machine-readable provenance markings or watermarks in generated content, which users are forbidden to remove or tamper with (§15). Reuse rights
Yes, without asking permission. Terms §2 states that media edited and created with Nero AI, across all its services and software, are allowed for non-commercial and commercial use, so a result can be published, printed or sold without a separate licence request. Three conditions frame that freedom: you must own the rights to the source file you upload, you may not pass the output of a licensed third-party AI model to others as part of a hosted service or API without written consent, and any provenance watermark embedded by Nero must stay intact. On the vendor side, the business pages state that user data is never used to train models, which are built on publicly available datasets and refined through anonymised feedback. However, Nero reserves the right to store IP addresses to police service abuse, and may collect and share usage statistics with third-party model providers to demonstrate licence compliance.
