GDPR overview

GDPR is referenced concretely rather than claimed as a badge. The privacy policy cites COPPA, FERPA and the GDPR when explaining that the service is not directed at anyone under 13, and sets out rights of access, rectification, erasure and complaint, noting that erasure is not absolute since Piktochart reserves discretion to retain some information. The cookie policy goes further than most, naming the legal basis cookie by cookie: Article 6(1)(f) legitimate interest for necessary cookies, Article 6(1)(a) consent for targeting, performance and functionality cookies. Cross-border transfers are acknowledged openly, including to countries without an adequacy decision, with standard contractual clauses cited for AI training transfers. Three gaps remain: no Article 27 EU representative is designated, no DPO is named, and no Data Processing Agreement is published or offered anywhere on the site.

Who owns the data?

Piktochart's Terms of Use state plainly that you own your content. The same section then grants Piktochart, and any third party it assigns content to, a world-wide, perpetual, non-exclusive, royalty-free, assignable, sublicensable and transferable right to use and publicly display that content for any purpose. That licence is explicitly retroactive, covering material submitted before the latest update to the terms. Piktochart separately owns its own templates, interfaces and code, plus the aggregated and anonymised service data generated by your usage. Output produced by the AI features is not claimed by Piktochart. Ownership is therefore nominal: the licence attached to it is unusually broad.

Reuse rights

Users keep the right to reuse what they create, subject to the licence they grant in return. The more consequential clause sits in the privacy policy: by default, thumbnails of every visual you create and every image you upload are enrolled in Piktochart's AI training programme, and the company may use, distribute and license those images under its terms. You can leave the programme at any time by emailing ai-privacy@piktochart.com, and doing so does not restrict access to core features. The opt-out is forward-looking only: images already used cannot be untrained, and models may keep the patterns they learned. Training images may be transferred to international AI partners under standard contractual clauses, and are processed in anonymised datasets, in isolated environments, with identifying metadata stripped. Retention summary
Piktochart publishes no general retention period. The only explicit duration in the privacy policy concerns temporary image-processing data held in Google Cloud Storage, which is deleted automatically within 48 hours. On erasure requests, the policy says the company will erase as much data as possible while reserving the right to retain some information at its own discretion. Images already used for AI training cannot be removed from the models, and Piktochart keeps records of inclusion and opt-out requests for each image. Hosting summary

The privacy policy lists Amazon RDS for application databases, Amazon S3 for file storage and backups, Google Cloud SQL for further databases, Google Cloud Storage for temporary image-processing data, and Firebase for the commenting module. Temporary data held in Google Cloud Storage is removed automatically within 48 hours. No country and no region is stated anywhere on the site, and a targeted search confirmed the absence. The policy is explicit in the opposite direction: personal data may be transferred to organisations in countries that have not received a GDPR adequacy decision, and images enrolled in AI training may go to international training partners under standard contractual clauses.
