GDPR overview

GDPR compliance is claimed concretely rather than in passing. The trust centre lists GDPR alongside SOC 2 Type 1 and Type 2, CCPA, the EU-U.S. Data Privacy Framework, the Swiss-U.S. DPF and the UK Extension. A Data Processing Addendum is offered for customers processing personal data under the GDPR and CPRA. Transfers to the United States rely on those framework certifications plus standard contractual clauses and the UK Addendum, with BBB National Programs DPF Services as free independent recourse. Rights covered include rectification, erasure, restriction, portability in a structured machine-readable format, and disclosure of categories collected, sources, retention periods, purposes and third-party recipients. The data protection officer is reachable at privacy@wistia.com. Two gaps stand out: no Article 27 EU representative is named in any legal page collected, and the policy never states in so many words that Wistia is GDPR compliant.

Who owns the data?

Wistia's terms are explicit: the Customer owns all right, title and interest in and to the Customer Content. Uploading grants Wistia a royalty-free, fully paid-up, irrevocable, worldwide licence, but only as necessary to provide the Services, so the licence follows the product rather than opening a separate commercial use. Wistia and its licensors retain ownership of the Services themselves, excluding Customer Content and Customer Data. One carve-out deserves attention: for AI Content generated by the AI Tools in response to your material, the terms warn that you may not own all right, title and interest, and that such output may not be eligible for intellectual property protection at all.

Reuse rights

Because the customer keeps ownership of its content, that content can be reused, republished, exported or moved elsewhere without asking Wistia's permission; the stated exception is AI Content, whose ownership the terms deliberately qualify. On Wistia's own side, the privacy policy effective 20 March 2026 relies on consent, legitimate interest and performance of the contract. The trust centre states that Wistia does not use private customer data to train proprietary AI models, relying instead on commercially available large language models, and that full videos and audio are never shared with AI providers: OpenAI receives text transcripts only, retained for a maximum of 30 days. The AI Policy effective 27 August 2025 names Amazon Bedrock, Deepgram, HeyGen and OpenAI as the AI platforms in use, and the published subprocessor list adds ElevenLabs, Auphonic, 3Play Media, AWS, Fastly, Mux, Algolia, Clearbit, Retool and Ashby. Under the CCPA, Wistia says it does not sell data in the traditional sense but does disclose it to its own Customers, with an opt-out available through its data request page. AI transcript and metadata features can also be switched off at account level, and the domain's robots.txt carries the signals search=yes, ai-input=yes, ai-train=no.

Under the privacy policy effective 20 March 2026, logs from unknown users are kept for 30 days, while logs from known users are kept for as long as Wistia has reason to believe the user will return. Marketing emails are retained while the corresponding marketing activity continues. Media is hosted and stored for the life of the customer account, plus up to three years. Beyond these rules, retention depends on the nature of the customer relationship, ongoing projects, the type of data and business needs. The trust centre adds that all account data is deleted on written request after termination, and that a deleted media file disappears from all systems within 30 days, though backup copies may survive for a period after erasure. Fastly acts as the content delivery network: the apex domain resolves to an anycast Fastly node.
