GDPR overview

Section 11 of the privacy policy is devoted to EU residents and states that GDPR principles prevail over the policy wherever the two conflict. It names concrete rights: access (Article 15), rectification (16), erasure (17), restriction (18), notification (19) and objection (21), all exercised through a single address, legal@merchynt.com. UK residents are covered under the Data Protection Act 2018 on the same terms. Beyond that, the implementation is thin. No Article 27 EU representative is designated and no data protection officer is named. No data processing agreement is published and no subprocessor list exists. Data is processed and stored in the United States, and the policy warns non-US residents that American law may protect them less. The policy is dated 1 March 2025.

Who owns the data?

Merchynt LLC retains all right, title and interest in the Services and its intellectual property; the terms grant a limited, non-transferable licence and transfer no ownership whatsoever. Any feedback, ideas or suggestions a customer offers can be folded into Merchynt's products with no compensation and no expectation of confidentiality. Personal data volunteered by users remains theirs to review, correct or delete on request to legal@merchynt.com, and Merchynt states plainly that it does not sell it. Reuse rights

The published terms say remarkably little about what a customer may do with the output. Merchynt's own licence is broad: section 5.2 lets it use and disclose data derived from the Services on an aggregated, anonymous basis, and use that data internally to operate, maintain, develop and improve its offerings.
