GDPR overview

Implementation is concrete and documented rather than merely claimed. The privacy policy (effective 4 April 2026) is completed by a Europe Privacy Policy Addendum (effective 24 April 2025) naming X.AI LLC as controller, setting out legal bases and listing access, rectification, erasure, objection, restriction and portability rights. A Data Protection Officer is reachable at privacy@x.ai and a single privacy portal handles requests. A public Data Processing Addendum (effective 9 June 2025) carries Standard Contractual Clauses, modules one and two, plus the UK Addendum, and commits xAI to its obligations under applicable data protection laws, GDPR included. European, UK and Swiss privacy contacts are named. One caveat is stated openly: correcting inaccurate personal data inside a model output may not be technically feasible.

Who owns the data?

The consumer FAQ states plainly that you own the inputs you submit and the outputs Grok returns, and that you may use those outputs commercially, with attribution requested under the brand guidelines. Ownership is not exclusivity, however. The terms grant X.AI LLC an irrevocable, perpetual, transferable, sublicensable, royalty-free and worldwide licence to use, copy, store, modify, publish, display and make derivative works of your content, for any purpose. That licence extends to any person's image, likeness or voice appearing in what you submit, and you warrant you hold the rights to grant it. Authorised staff may review content for product, security and legal purposes.

Reuse rights

End users may reuse their outputs freely and without asking permission, including for commercial purposes; xAI only asks that generated work be attributed to Grok as set out in its brand guidelines. Two limits are stated. Outputs are not guaranteed to be unique, so another user may receive something similar and your rights do not override theirs. And xAI may attach a disclosure marking content as generated or altered by artificial intelligence. On the publisher's side, content may serve to maintain the service, improve products, run market and customer research and train models, unless you switch training off in the data controls or use Private Chat. Business and enterprise content is never used to improve models, and data is not sold or shared for marketing or advertising.

You decide how long your data stays. Conversations remain on your account for as long as you want, and you can delete a single conversation, your whole history or your account from the settings on web and mobile. Once deletion is requested, the data is removed from xAI systems within 30 days. Private Chat behaves the same way: the history is not visible to you and is deleted within 30 days, and it is never used for training. People who use Grok without registering have no data retained for their own use after the session. Two exceptions apply: content that has been de-identified or pseudonymised and disconnected from your account, and content xAI must keep for safety, security or legal reasons. xAI states that it processes all personal information in the United States, where it maintains its primary data centres, and its published subprocessor list places every named provider in the US, including AWS, Google Cloud, Oracle, Cloudflare, MongoDB, Stripe and Vercel. The Data Processing Addendum allows transfers outside Europe to the United States and other countries where xAI and its subprocessors operate.
