GDPR overview
There is no GDPR mention at all. A search across every page retrieved returns no occurrence of GDPR, CCPA, DPO, legal basis, rights of access, rectification or erasure, international transfers or retention period. The privacy policy is short, about one page, and carries an effective date of April 16th 2023. It relies on consent by use: "By using the Website, you consent to the data practices described in this policy." Privacy questions go to a generic address: "If you have any questions about this Privacy Policy, please contact us at hello@promptbase.com." Who owns the data?
The terms make prompts the intellectual property of their respective creators: "You acknowledge that you do not acquire any ownership rights to the prompts by purchasing or using them." A buyer receives a non-exclusive, worldwide, perpetual license for any purpose, excluding harmful or illegal uses and excluding resale, redistribution or transfer without the creator's written consent; PromptBase may terminate it if those restrictions are breached. Sellers keep everything: "You retain all rights to your prompt, and are welcome to remove it from PromptBase at any point." Reuse rights
The privacy policy lists what is collected: an email address at sign-up or newsletter subscription, plus an IP address and usage data through cookies and Google Analytics. The email address is used to send notifications and announcements of new features; the IP address is used for the security of the site and its users. The only third parties it names are Stripe for payments and Google Analytics for audience measurement. Two technical observations exist, and they are observations rather than commitments made by the publisher. The domain resolves to 199.36.158.100, an address in AS54113 Fastly, an anycast network whose exit point is in the United States. Profile pictures and visuals are served from firebasestorage.googleapis.com, which belongs to Google Cloud, and from assets.promptbase.com. Neither observation says where accounts, purchases or personal data are actually stored, and neither amounts to a contractual guarantee: a content delivery address indicates a delivery point, not a storage jurisdiction. Anyone who needs a documented hosting jurisdiction will have to ask for it, since the site does not answer the question.
