Emergence AI, operated by Merlyn Mind, Inc., describes itself as a frontier AI lab turning cutting-edge agentic research into enterprise infrastructure. The vendor claims a 5 to 10x acceleration of the manufacturing cycle, and 86% on the LongMemEval long-memory benchmark above 100k tokens, presented as state of the art. The research trail is public: twelve arXiv papers on world models, reflection-based memory, SEAL, production guardrails and RAG, plus a product lineage running from Agent-E (web control agent, May 2024, claimed 10-30% above the state of the art) through Orchestrator (December 2024), agents building agents (March 2025) and CRAFT (June 2025). GDPR overview

GDPR implementation is documented and concrete. A published Data Processing Addendum covers EU GDPR, UK GDPR, the Swiss FADP, CCPA/CPRA, FERPA and US state privacy laws. The EU Standard Contractual Clauses (Decision 2021/914 of 4 June 2021) and the UK Addendum are incorporated, and the Swiss FDPIC is named as the supervisory authority for transfers governed by the FADP. Emergence commits to assist with data protection impact assessments and prior consultation of supervisory authorities, and to cooperate on breach notification without undue delay. EEA residents are granted access, rectification, erasure, objection and portability rights, with a 30-day response target and requests sent to privacy@emergence.ai, and the right to complain to a supervisory authority is restated. Two gaps: no Article 27 EU representative and no data protection officer are named.

Who owns the data?

The Data Processing Addendum dated 15 September 2025 makes the customer the Data Exporter and controller, and Emergence AI the Data Importer and processor. The customer keeps ownership of its personal data, and Emergence processes it on the customer's behalf. The addendum defines Company Account Data and Company Usage Data separately from customer data. For visitors to www.emergence.ai, Emergence acts as a data controller in its own right under the GDPR. One boundary matters: the published privacy policy covers the marketing website only, not the product, so the ownership terms that would apply to a deployment have to be obtained during contracting.

Reuse rights

Under the DPA, Emergence AI processes customer personal data only on the customer's documented instructions, so the customer keeps control of its own data and needs no permission to reuse it. Sub-processors are covered by a written general authorization, with prior notice and a ten-day right to object, and must be bound by written contract. On the website side, Emergence collects IP address, device identifier, browser, operating system, language, country and pages visited, together with cookies. It states that it does not serve targeted advertising on its website and does not track visitors across other websites or online services. Marketing use is possible, with opt-out through the unsubscribe link or privacy@emergence.ai. No published document, whether the privacy policy, the DPA or the terms, says whether customer data may be used to train models.

Data retention & training

Retention summary
At the end of the service, the DPA gives the customer the choice: Emergence returns or deletes the customer's personal data, unless further storage is required or authorized by applicable law. Where return or destruction is not possible, the data must be isolated and kept protected. A deletion certificate is provided under clauses 8.1(d) and 8.5 of the EU Standard Contractual Clauses, and the processing and retention periods themselves are referred to Exhibit B-1 of the addendum. Hosting summary

The privacy policy is explicit: information is transferred to, processed and stored in the United States, and visitors located elsewhere are told so directly. Where transfers out of the EEA require it, the Standard Contractual Clauses are implemented, and the DPA also incorporates the UK Addendum, with the Swiss FDPIC named as supervisory authority for transfers governed by the FADP.
