Compliance is claimed explicitly: the trust centre lists GDPR as compliant and the home page advertises EU hosting. A full data processing agreement is published openly, naming the parties, the single subprocessor, the transfer safeguards and a schedule of data categories. The privacy policy, last modified in June 2025, sets out access, portability, rectification, erasure, restriction and objection rights, plus the right to complain to a local supervisory authority; privacy requests go to contact@fairfox.ai. Transfers outside the EEA rely on an adequacy decision, the standard contractual clauses of Decision C/2021/3972 or another lawful basis. Who owns the data?

The customer keeps everything. Under the licence agreement the customer retains all right, title and interest in its data, and Fairfox receives only a non-exclusive licence limited to what is strictly necessary to deliver the service; customer data is also treated as the customer's confidential information. Under the data processing agreement the customer is the controller and Fairfox acts as processor. The material entrusted is sensitive by nature: employee identifiers, pay and compensation, demographic data such as gender, age and ethnicity where supplied, employment records, performance and qualifications, covering both current and former employees of the customer.

Reuse rights

The customer stays in control of its own material: Fairfox processes it to deliver the pay equity service and on the customer's documented instructions, and the customer is free to export results, change lists and regulatory reports and reuse them as it sees fit, including by re-entering them into its HRIS. One clause deserves attention. The licence allows Fairfox to aggregate and anonymise customer data so that it identifies neither the customer nor any individual, and to use that aggregated, anonymised material to improve the platform and its underlying analytical models. The same clause draws a line: customer data, aggregated or not, may not be used to provide benchmarking or comparative analytics to other customers without prior written consent. Retention summary
On the product side the rules are precise. Within 30 days of the agreement expiring or being terminated, Fairfox returns a complete copy of the customer data by secure transfer if the customer asks in writing, then deletes all remaining copies, including at its subprocessor. The DPA schedule repeats it: customer personal data is kept for the duration of the agreement and deleted within 30 days of its end, except where law requires retention — residual copies are then limited to what the law imposes or to establishing and defending legal claims. Hosting summary

Fairfox commits contractually to keeping customer data inside the European Union: the licence states that customer data is stored and processed within the EU and will not be transferred outside the EU or EEA without the customer's prior written consent, except as permitted by the data processing agreement.
