GDPR overview
Implementation is concrete and documented. The privacy policy, effective 25 May 2018, names Transmetrics AD as data controller, with its Sofia registered office and UIC 203327443, and presents itself as a notice under Articles 13 and 14 of Regulation (EU) 2016/679. Data subject requests go to a named contact, Desislava Simeonova, by email or letter. The listed rights cover information, access and copy, rectification, erasure, restriction, portability, objection to direct marketing and withdrawal of consent. The Bulgarian Commission for Personal Data Protection is named as supervisory authority. The security page states GDPR compliance, EU hosting and a DPA available on request. No data protection officer is formally designated, and no Article 27 representative is named, which is expected for a controller established inside the EU.
Who owns the data?
The terms are unusually explicit. Clause 2.1.1 states that everything the client uploads remains the client's exclusive intellectual property, and clause 2.1.2 confirms the client is and remains the sole owner of all rights and title in that data. Accuracy, legality and copyright of the uploaded material stay the client's responsibility. Transmetrics keeps ownership of its own software and of the derivative results produced during the contract, and grants only a non-exclusive, non-transferable licence for the contract term. Both the client data and the forecasts returned are treated as confidential information. Transmetrics undertakes never to share, rent, sell or copy client data, during or after the agreement.
Reuse rights
The client keeps ownership but grants Transmetrics what the contract calls an unconditional permission, for the duration of the agreement, to access and use its data for five stated purposes: delivering and supporting the service; developing, modifying, customising or enhancing the product; conducting research, expressly including improving the forecasting accuracy and optimisation power of the product; producing anonymised aggregates and publishing highly aggregated indexes pooling many companies so that no single client can be isolated; and any other purpose only with case-by-case written consent. In the other direction the client may use the deliverables it receives without asking again, under an exclusive but non-transferable and non-sublicensable right, except where a deliverable carries Transmetrics intellectual property or trade secrets, which are licensed royalty-free but strictly for the agreed purpose. Reverse engineering, resale and derivative works are prohibited. After termination the vendor may no longer use client data to build aggregates, but keeps the results already produced.

The security page states that customer data is stored and processed in the European Union, and the privacy policy is more specific, naming Bulgaria as the place of storage and processing, alongside wherever the company, its partners, affiliates and third-party providers maintain facilities. Transfers are limited to jurisdictions whose data protection laws reflect the same commitment. Access is role-based and data is encrypted in transit. The company describes physical, personal, technical and administrative safeguards, ongoing testing of its security technology, access restricted to staff and processors who need it, and staff training on confidentiality. Independently, the public website itself resolves to a Bulgarian host in Sofia, which is consistent with the stated jurisdiction, though the vendor never names the infrastructure provider behind the platform itself. A data processing agreement is available on request rather than published, and no subprocessor list for the platform is public.
