Annex A of the data processing agreement describes it as un innovador asistente de inteligencia artificial diseñado para optimizar las labores jurídicas de los equipos mediante una plataforma SaaS — a chat interface that works from legislation and public legal sources. Use begins with a choice of temática: the publisher presents its list of topics as a practical manual of employment law and insists that picking the right one shapes the quality of the answer. Two modes are advertised, an Asistente laboralista for employment matters and an Asistente general positioned as a multi-sector technical assistant covering IT, medical questions, new technologies and prompting technique. On the engine side, the home page FAQ claims all the functionality and possibilities offered by ChatGPT 4 plus a specific body of employment knowledge, and Annex B names OpenAI Ireland Ltd as the subprocessor handling natural language processing. GDPR overview
Implementation is concrete rather than declarative. The privacy policy, effective 1 April 2024, cites the GDPR and Spain's Ley Orgánica 3/2018 (LOPDGDD) and lists seven rights — access, rectification, erasure, restriction, objection, portability and complaint to the supervisory authority — exercised through info@ialaboral.com. A full data processing agreement is embedded, with Annex A (nature of the processing), Annex B (pre-approved subprocessors) and Annex C (security measures). It grants an annual audit right, promises breach notification within 36 hours, commits to processing solely within the EU and the EEA, provides for cooperation on impact assessments, and claims privacy by design and by default. No DPO is named and no Article 27 representative is designated, the company being established in the EU. One internal contradiction stands: the general section says personal data may be transferred and processed outside the user's country of residence, against the DPA's EU/EEA-only pledge.
Who owns the data?
Under the terms and conditions, users keep the intellectual property of the documents they provide, and those documents feed only that user's individual knowledge base. Generated outputs are framed as derivative work produced during each user's own interaction, and the subscriber may use them for its own purposes. In exchange the subscriber grants the publisher a limited, revocable license to use, store, copy, transmit and display the Inputs solely to deliver the service, keeping every other right. Feedback sent to the publisher belongs to the publisher, without compensation. Reuse rights
The subscriber can reuse its own material without asking for permission: uploaded documents remain the user's intellectual property, and generated answers may be used for the user's own purposes. On the publisher's side, personal data is processed to create and manage accounts, answer requests, improve the service, meet legal obligations and prevent fraud, and — only with prior express consent — to send marketing. Technical data is also collected automatically: device, browser, IP address, operating system, geographic location, MAC address, action history, sessions and cookies. IALaboral states that it neither accesses nor analyzes the Inputs or the generated results, and undertakes not to use them to train generative AI models unless separately agreed in writing, for example for specific fine-tuning; the employment law landing page adds that data is not used to train public models. Aggregated and anonymized usage data may be exploited to improve performance and experience, provided it cannot be traced back to the subscriber. One nuance matters: data is transmitted in decrypted form over HTTPS to the external natural language processing servers, so the at-rest encryption tied to the user's key does not cover that step. The disclosed subprocessors are Amazon, for hosting and search, and OpenAI Ireland Ltd, for natural language processing.

One caveat: the general section of the privacy policy states that, because the company operates globally, personal data may be transferred and processed outside the user's country of residence. That wording sits against the EU/EEA-only commitment of the DPA, and the site does not reconcile the two.
