GDPR overview
GDPR is addressed explicitly. The privacy policy names Regulation (EU) 2016/679, sets consent as the legal basis and states it can be withdrawn at any time. It limits processing to identifying and technical data, ruling out Article 9 special categories, and lists the seven data subject rights. Requests are made in writing under the reference “RGPD-www.clairetool.com”, to the registered address or to dataprotection@clairetool.com. The Portuguese supervisory authority, Comissão Nacional de Proteção de Dados, is named. As the publisher is established in Portugal, no Article 27 representative is required. Missing, however, are any data processing agreement, any designated data protection officer and any published list of subprocessors.
Who owns the data?
The controller is CLÉRIGO & LOPES, LDA., represented by Rafael Clérigo Gonçalves. Personal data collected through the site forms is held in an automated file under the company's responsibility, and is used to run the contractual relationship as well as for commercial, personalisation, operational and statistical purposes and market studies. The privacy policy states that user personal data is not shared with third parties, although the terms name Easypay as payment provider and the cookie page names Google Analytics. Clinical values, images and interpretations entered into the platform remain, under the terms, the sole responsibility of the practitioner who enters them.
Reuse rights
The terms grant the user no reuse licence over the platform's content. All intellectual and industrial property in the website and its elements belongs to the company and is protected under Portuguese law. Reproduction, distribution and public communication of all or part of the content for commercial purposes are expressly prohibited without written authorisation, in any medium and by any technical means. Users may view, print, copy and store elements on their own device strictly for personal use, and may not remove or tamper with any protection or security mechanism. Nothing in the documents addresses what the practitioner may do with the clinical data they enter, beyond making them responsible for it.
Data retention & training
Hosting summary
The site never states where user data is hosted. No country, region, data centre or infrastructure provider is named, on the public pages or in the application's own legal documents. What is published is limited to security posture rather than location: the FAQ says all data is secured and backed up daily, that HTTPS encrypts traffic between the practitioner's computer and the cloud, and that card numbers are encrypted at rest with AES-256 by the payment provider. Jurisdiction can be inferred only indirectly, from the terms being governed by Portuguese law and from the Portuguese Comissão Nacional de Proteção de Dados being named as supervisory authority. There is no transfer clause for destinations outside the European Economic Area and no mention of standard contractual clauses. A practice with hosting requirements of its own should request this information directly, as the published documents do not answer it.
