What sets NightCafe apart is that it deliberately refuses the productivity framing. The publisher states plainly that most AI art tools aim at product mockups and marketing assets, while it targets hobbyists and people who simply want to enjoy creating. That choice shapes the whole product: an official daily art challenge with public voting, creation streaks, badges, chat rooms, public galleries, and the ability to follow other artists. GDPR overview
NightCafe addresses the GDPR explicitly rather than by implication. Its privacy policy, last updated on 23 November 2023, is written under the Australian Privacy Act 1988 but carries a dedicated appendix for people located in the EU, the EEA and the United Kingdom. That appendix sets out a legal basis for each processing purpose, namely contract, legal obligation, named legitimate interests and consent. It describes international transfers as relying on adequacy decisions or on standard contractual clauses, and it lists the rights of access, rectification, erasure, restriction, objection to automated decisions, portability and complaint to a supervisory authority. Requests go to a single address, hello@nightcafe.studio. Three things are missing: no EU representative under Article 27, no data protection officer, and no stated retention period. Data is stored in Australia, which holds no EU adequacy decision.
Who owns the data?
The terms of service transfer all intellectual property rights in an artwork to the person who created it, once the work has been generated and delivered, on condition that they own or are entitled to use any source assets such as reference images. Personal and commercial use is permitted, including on the free plan. NightCafe nevertheless retains a perpetual, non-exclusive, irrevocable, royalty-free and worldwide licence to host, store and display user content and artworks. Personal data remains governed by the privacy policy, which grants access, rectification and erasure on request. The publisher warns that copyright in AI-generated works is still unsettled in many jurisdictions.
Reuse rights
Users may reuse their own creations without asking permission. The terms assign the intellectual property rights in each artwork to its creator and explicitly allow both personal and commercial use, free plan included. The single condition is holding the rights to any original asset used along the way, such as a reference image. Content published to the galleries or posted in chat rooms may become publicly visible, and NightCafe keeps a perpetual licence to host, store and display it.
