GDPR overview
There is no claim of GDPR compliance. The privacy policy states the opposite: Ello does not offer its services in EU member states, on the grounds that it is not compliant with local law there. The texts it does cite are COPPA in the United States and the Data Protection Act in Kenya, where Ello is registered as a data controller with the ODPC. No Article 27 EU representative and no Data Protection Officer are named, and support@ello.com is the single contact for privacy matters. The rights offered - access, copy, objection, restriction, erasure, rectification, portability, withdrawal of consent and account deletion - resemble GDPR rights but rest on those other statutes. Ello states legal bases of contract performance, consent, legal obligations and legitimate interests, a 30-day response time (7 days in Kenya), breach notification to the competent authorities, and an incident response plan reviewed annually.
Who owns the data?
Ello, or its licensors, holds all rights in the Services and the content it supplies, and retains all rights in the machine learning models, algorithms and derivative works trained on user-generated content. Families keep the rights to their own User Content, and Ello gains no ownership beyond the licence granted to it: worldwide, non-exclusive, royalty-free and sub-licensable only to providers acting for Ello. It covers running and improving the Services, generating personalised books, and user-initiated sharing, and lasts while the content stays on the Services plus a reasonable purge window. Content carrying a child's name, image, voice or identifying data is used only to deliver the service or as the privacy policy allows.
Reuse rights
The licence granted to the user is personal, worldwide, royalty-free, non-assignable and non-exclusive, and it covers personal, non-commercial use only. Reselling, commercially exploiting or otherwise redistributing the site and the services is not permitted under it. Books a child builds in Story Creation are generated in real time from their own conversation and stay within that same personal scope. On the data side, families can ask for an export of their personal data in a transferable format, and can close the account by following the instructions set out in the terms of service.

Ello states that its services are hosted and operated in the United States. Data may be stored and processed on servers located in the United States or in other jurisdictions where its service providers operate, and users outside the United States consent to their data being transferred and stored outside their own jurisdiction. For Kenya, transfers out of the country require explicit consent along with contractual and technical safeguards under the Data Protection Act. For Canada, Ello warns that data transferred out of the country is subject to local law and to access by local authorities. Third-party providers cover hosting, storage, analytics and IT support, and are bound by contractual confidentiality obligations, but no named subprocessor list and no data processing agreement are published. On the security side, Ello describes encryption in transit and at rest, multi-factor authentication, restricted access controls and annual internal audits.
