GDPR overview
There is no mention of the GDPR at all. Neither the terms of service nor the privacy policy contains the words "GDPR" or "General Data Protection Regulation", names a data protection officer, designates an Article 27 representative in the European Union, cites a legal basis for processing, or lists the usual data subject rights such as rectification, portability or objection. The policy borrows one GDPR-flavoured phrase, "rights and freedoms of natural persons", without citing the regulation behind it. The rights actually described are US ones: the Californian CCPA, with access and deletion answered within 45 days, a Nevada sale opt-out, and California's Shine the Light provisions. No standard contractual clauses or transfer safeguards are published. The interface ships in twelve locales including German, French, Italian and Spanish, so a European audience is plausible without any documented GDPR framework behind it.
Who owns the data?
You keep ownership of what you post. The terms define anything you upload as your User Submission and make you solely responsible for it, while stating that FlowGPT owns the Services themselves. Notably, the document recovered contains no explicit licence granted by you to FlowGPT over your submissions. The privacy policy says uploaded content and images are stored on the company's servers, that you may delete them at any time, and that your data will not be modified, sorted or used beyond its intended function without your consent. Comments are public by design. The company states it does not sell personal data, but reserves the right to transfer it to a third party in a merger, acquisition or bankruptcy.
Reuse rights
Reuse is deliberately narrow. The privacy policy says only that uploaded content and images are "stored on our servers", naming neither a country nor a region, and no trust or security page could be reached. What can be established is jurisdictional rather than physical: the publisher, FlowGPT Co., is a US company registered in Oakland, California; the terms are governed by Californian law; and disputes go to JAMS arbitration in San Francisco County.
