Who owns the data?
The client organisation remains the data controller; the vendor acts strictly as a processor. Its data processing agreement is published, alongside a sector-specific version drawn up by the Branchorganisatie Zorg for healthcare. Processing takes place solely on the controller's written instructions, and the processor commits not to use the personal data for any purpose of its own. Further sub-processors may only be engaged with the controller's prior written consent, and must be bound by at least the same obligations.
