GDPR overview
GDPR commitments are concrete, but they live in the terms of service rather than in the privacy policy. S2data declares in legally binding terms that it takes all measures required to secure processing under Article 32, and undertakes to provide the technical and organisational measures that let the customer honour Chapter III rights: information, access, rectification, erasure, portability, objection and automated decision-making. Breach notification to the supervisory authority and to affected individuals, data protection impact assessments and prior consultation are named explicitly. Processing is contractually confined to the EU or the EEA. The GDPR contact is privacy@s2-data.at. The caveat is one of scope: the published privacy policy is a website template covering comments, accounts and cookies, so every product-level GDPR fact above comes from the contract.
Who owns the data?
The General Terms and Conditions place the customer in the role of controller and S2data GmbH in the role of processor. Data provided by the customer is processed on the customer's behalf, and the customer is granted the right to inspect and audit the processing facilities at any time. S2data may bring in sub-processors and is expressly not required to announce them, but it must sign Article 28(4) agreements with them and remains liable for their compliance. One commercial right is reserved to the vendor: it may name the customer as a reference. The website privacy policy covers only visitors to the marketing site and says nothing about platform data.
Reuse rights
The contract frames data use narrowly: information supplied by the customer serves the delivery of the optimisation service itself. In practice the platform ingests master data and orders, MRP call-offs, and the constraints attached to them, then returns loading plans, route sequences, cost and TCO views, CO2e reports and audit evidence that the customer is free to use in its own systems. Two points are worth stating plainly. First, nothing in the terms or the privacy policy addresses whether customer data is used to train models, in either direction: the subject is simply never raised. Second, the only third parties named anywhere concern the marketing website alone, not the product: Leadinfo B.V. of Rotterdam, which identifies visiting companies from their IP address and offers an opt-out, and WP Statistics, whose anonymous counts are stored on the publisher's own server without cookies.

The terms of service state that the software is installed by the publisher on the infrastructure of Hetzner Online GmbH, and that data processing activities are carried out exclusively within the EU or the EEA. Those two statements are the whole of what is disclosed: the provider is named and the region is fixed contractually, but no country of hosting is published, so none is asserted here. Technical observation, which the publisher does not itself publish, is consistent with that: the domain resolves to an address operated by Hetzner Online GmbH in Nuremberg, and the name servers belong to the same provider. This corroborates the contract without replacing it. One alternative changes the picture entirely. The terms also allow a customer to license the software and install it on its own servers, in which case hosting is the customer's own and the arrangement above no longer applies.
