GDPR overview

The privacy notice, hosted on Termly and last updated on 17 January 2024, carries a dedicated section for EU and UK visitors. It names the GDPR and the UK GDPR, lists the legal bases relied on - consent, legal obligations, vital interests - and grants access, rectification, erasure, restriction and portability rights through a data subject access request. What it never does is claim compliance in so many words, which is why this record marks GDPR compliance as N: silence on the claim, not a denial. Three gaps back that reading. No representative is designated under Article 27, although the notice declares that EU personal data is collected; no data protection officer is named; and no international transfer framework is described for a US-based company. All privacy requests go to one generic address.

Who owns the data?

The terms state that you own every asset you create with the service, to the fullest extent applicable law allows, and that this ownership survives a downgrade or a cancellation. Two reservations apply: the obligations of the agreement itself, and the rights of any third party.
