Foundor.ai is an Austrian web platform that compresses the earliest work of starting a company into a single guided chain: idea, analysis, brand, business plan, pitch deck. Its own positioning line is Business Planning, Supercharged by AI, and the mission stated in its FAQ is to enable everyone to turn a business idea into reality.

The unit of work is the Idea: a personal project space saved to your account, built up through guided questions and revisited whenever you want. Your subscription tier decides how many Ideas you may create each month. Around that unit, the home page lays out four steps.

Step one evaluates the idea. GDPR overview

Implementation is substantial but uncertified. The controller, Foundor.ai FlexCo in Doppl, Austria, is established in the EU, so no Article 27 representative is required; a data protection contact answers at support@foundor.ai. The privacy policy sets out access, rectification, erasure, objection, portability and withdrawal of consent, names the Austrian Datenschutzbehoerde as supervisory authority, and publishes a named list of thirteen processors with purpose, legal basis, registered office and transfer basis (standard contractual clauses under Art. 46.2.c, plus the EU-US Data Privacy Framework for Google). TLS encryption and locally hosted fonts are claimed under Art. 25.1. Weaknesses: no DPA is offered to customers - the Article 28 contracts cited are the publisher's own - no SOC 2 or ISO 27001 certification is claimed, and the policy still describes Sentry as EU-US Privacy Shield certified, a framework invalidated in 2020.

Who owns the data?

Section 4.2 of the terms reserves to Foundor.ai FlexCo every exploitation and industrial property right in its own Services - analysis tools, texts, designs, images, graphics and materials it supplies - that is not expressly granted. Section 4.1 gives the registered user only a paid, non-exclusive, non-transferable right of use, limited to the term of the contract. Critically, the terms never say who owns the business plans, pitch decks, names and logos the user generates; they address only the publisher's property. Section 8.4 lets the publisher delete the account and all stored data once the contract ends, backups being the user's responsibility, and section 11.2 excludes any obligation to restore lost or deleted data.

Reuse rights

The licence in section 4.1 covers use of the platform itself, not the reuse of what it produces: because the terms assign no ownership over generated content, users are given neither written permission nor written restriction as to what they may do with an exported plan or deck, and section 10.2 adds that no warranty is given that outputs are free of third-party rights. On the personal-data side, the privacy policy lists the categories collected - account details, usage and browsing, marketing, technical data such as IP and device identifiers, support chat logs, feedback and aggregated data - states that no special categories under Article 9 are collected, and relies on consent, contract, legal obligation and legitimate interest as legal bases. Thirteen recipients are named, among them OpenAI, LLC in the United States and Microsoft Ireland for enterprise Azure OpenAI processing confined to EU data centres. The policy states that there is no profiling or automated decision-making. Neither the terms nor the privacy policy take any position on whether customer data is used to train models, and no opt-out is documented.

Data retention & training

Retention summary
Data is kept only as long as the purpose of collection requires. Austrian tax law obliges the publisher to keep contracts and documents from the contractual relationship for seven years. In justified individual cases, such as asserting or defending legal claims, data may be stored for up to thirty years after the business relationship ends. Details of interested parties who never became customers are kept for up to three years from the last contact. When the contract ends, the terms allow the publisher to delete the account and all stored data, and exclude any right to have lost or deleted data restored, so exporting your own work is your responsibility. Hosting summary

The publisher does not operate its own data centres. The website host server is in Germany, with Hetzner Online GmbH of Gunzenhausen named as the hosting provider, and technical operation, hosting and maintenance are handled by the Austrian parent, Valcome Innovation GmbH in Leonding; both sit inside the EEA.
