NightCafe addresses the GDPR explicitly rather than by implication. Its privacy policy, last updated on 23 November 2023, is written under the Australian Privacy Act 1988 but carries a dedicated appendix for people located in the EU, the EEA and the United Kingdom. That appendix sets out a legal basis for each processing purpose, namely contract, legal obligation, named legitimate interests and consent. It describes international transfers as relying on adequacy decisions or on standard contractual clauses, and it lists the rights of access, rectification, erasure, restriction, objection to automated decisions, portability and complaint to a supervisory authority. Who owns the data?
