GDPR overview

GDPR is addressed once, in section 2.6 of the terms of use: personal data must be handled in line with all applicable privacy laws, 'including without limitation the GDPR', and where the contract requires an exchange of personal data the parties must settle their respective roles under the GDPR and, where required, sign a separate written agreement. Beyond that clause the implementation is thin. The privacy notice, last updated and effective 11 February 2024, is built around United States law: it carries a California Privacy Law appendix and a California rights section, but no GDPR section, no legal bases for processing, no retention periods and no Article 27 EU representative. Access, deletion and correction rights are offered to everyone through the contact page, and international transfers are acknowledged openly. No DPA and no subprocessor list are published.

Who owns the data?

Decktopus Inc states in its terms of use that the platform, its features and its content are the exclusive property of Decktopus and its licensors, and that its trademarks may not be reused without written consent. The terms retrieved say nothing explicit about who owns the decks a customer generates, which is a notable silence. One transfer is spelled out: any feedback, idea or suggestion sent to support@decktopus.com becomes the sole property of Decktopus, through an irrevocable assignment of rights and a waiver of moral rights.
