Ometrics states outright that it is GDPR and CCPA compliant on a dedicated page, and describes itself as a data processor with the customer acting as controller. Who owns the data?
Ometrics LLC's terms state plainly that Customer Data remains your property, and the company positions itself as a data processor with the customer acting as controller. That ownership sits alongside a broad licence, described as royalty-free, sublicensable, transferable, perpetual, irrevocable, non-exclusive and worldwide. Ometrics may use the data to deliver the service and, where it is not reasonably identifiable to an individual, to develop, maintain and improve the service, to market it, and to produce reports. Personally identifiable information is not rented or sold. One clause deserves attention: customer names and email addresses may transfer with the business in a sale, merger, bankruptcy or liquidation.
Reuse rights
The terms address the merchant rather than the shoppers who talk to the bot, and it is the merchant who warrants having obtained end-user consent before passing anything to Ometrics. As that merchant you keep ownership of Customer Data and may reuse it freely, but Ometrics reserves wide latitude of its own. Beyond running the service, it may work from de-identified data to build reports, improve functionality and market the product, without asking again. The privacy policy separately discloses a WebVisitorJourneys pixel used to obtain personal information for marketing purposes, alongside Google Analytics and DoubleClick retargeting. Product pages promise that store information is never fed to public LLMs such as ChatGPT, but no clause in the terms turns that promise into a contractual commitment.
