GDPR overview

The GDPR is addressed head-on rather than in passing. Clause 11 of the terms names Mentioned as data processor and the customer as data controller, then commits the vendor to processing data only for the service or the law, imposing a duty of confidence on anyone with access, applying appropriate technical and organisational security measures, assisting with data subject rights, breach notification and impact assessments, informing the customer if asked to do something infringing, and accepting its own direct liability. Customers may audit through an independent external auditor's report no older than eighteen months, or through their own inspection, provided the audit fee is paid in full and in advance. Special-category data is banned from the platform. What is missing is equally concrete: no Article 27 representative, no named DPO, no dedicated privacy address, no published subprocessor list and no effective date on either document.

Who owns the data?

The terms cast Mentioned as the data processor and the customer as the data controller, so ownership of and responsibility for the personal data pushed through the service stay with the customer. Mentioned undertakes to process that data only to deliver the service or to satisfy the law, to bind anyone with access to a duty of confidence, and to provide mechanisms for downloading all personal data at any time, deleting a single data subject, or deleting everything at the end of the contract. Separately, users grant Mentioned a non-exclusive, worldwide, perpetual licence to copy, distribute, transmit, display and reformat their content, for the purpose of running the service.

Content that users submit or create remains theirs, and the terms carve out an explicit right to download it as part of normal use, outside the general ban on downloading, converting, crawling or reverse-engineering the service. Everything Mentioned publishes itself, from text and graphics to logos, page layout and underlying code, belongs to the vendor and may not be reproduced, copied, distributed or stored without written permission, save where the exceptions of the Copyright Designs and Patents Act 1988 apply.
