GDPR overview
Implementation is unusually concrete for this segment. MARA Solutions GmbH is established in Germany, so the GDPR applies directly and no Article 27 representative is needed. A data processing agreement under Article 28 is published as a versioned PDF, in force since 3 September 2024, with earlier versions kept online. A public subprocessor list, revision 1.0.6 dated 28 April 2026, names twelve providers with their processing location and safeguards, including 2021/914 standard contractual clauses. The agreement grants audit rights and details technical and organisational measures in an appendix. The privacy policy cites Articles 15 to 18, 20, 21 and 77 alongside the German BDSG. Two caveats: that policy dates from 9 September 2022 and covers the website rather than the product, and MARA itself holds no security certification.
Who owns the data?
The customer remains the data controller and MARA Solutions GmbH acts as processor under a published Article 28 GDPR data processing agreement. Reviews and replies stay the customer's; MARA corrects, restricts or deletes them on instruction, returns them in a structured, machine-readable format, and deletes or destroys everything at the end of the contract unless a statutory retention duty applies. One carve-out deserves attention: under clause 2.5 of the terms, MARA owns what it calls Production Data, meaning anonymous insight generated from usage and aggregated across customers. The terms state this contains no customer data, confidential information or personal data, and MARA may exploit it to improve its products.
Reuse rights
Customers get a non-exclusive, non-transferable and non-sublicensable right to use the service for the term of the agreement, and may not open access to third parties. Their own content is another matter: reviews, replies and analytics belong to them, can be exported at any time, and the terms add EU Data Act switching rights, with a thirty-day transition window to port exportable data or have it erased. Processing is delegated to twelve named subprocessors. Amazon Web Services and Vercel host, DeepL and Google Cloud translate, Grepture runs an AI gateway with PII redaction inside the EU, and OpenAI, Anthropic and Microsoft Azure host the models. For OpenAI and Anthropic, MARA states that customer data is not used for model training. Brand Voice is the nuance: it does fine-tune on the replies a customer has already published, but for that customer's own account.

Hosting summary
The data processing agreement states that processing takes place in principle on the territory of the Federal Republic of Germany, or within the European Union or the European Economic Area. Processing elsewhere requires the customer's prior consent and must satisfy Articles 44 to 49 GDPR. Hosting itself sits with Amazon Web Services EMEA SARL and Vercel, both processing in the European Union. The published subprocessor list is precise about the rest: DeepL, Grepture, Sentry, Customer.io, Pusher, Google Cloud and Microsoft Azure all process in the EU, while OpenAI, Anthropic and Intercom process in the United States under 2021/914 standard contractual clauses. Grepture, which runs the AI gateway and personal data redaction, states that all its infrastructure is hosted exclusively within the EU with no transfers outside it. One technical caveat: the website's IP address resolves to a Cloudflare anycast node, which says nothing about where customer data actually lives.
