Floorfy AI Studio is the artificial intelligence content module of Floorfy, a Barcelona-based real estate marketing platform. GDPR overview

GDPR implementation is documented rather than merely claimed. Floorfy, S.L. is established in Spain, so the Regulation applies directly and no Article 27 representative is required. The privacy policy cites Regulation (EU) 2016/679 and the Spanish Organic Law 3/2018 (LOPDGDD), and sets out categories of data, purposes, legal bases, recipients, retention periods and data subject rights. A full data processing agreement is annexed to the terms of use and is expressly built on Article 28, including a record of processing activities under Article 30. Sub-processing runs on a general authorisation with a fifteen-day objection window. Transfers outside the EEA are covered by the EU-US Data Privacy Framework or standard contractual clauses. Who owns the data?

Under clause 3.9 of the terms, all content a customer uploads or generates, described as Client Content, remains the exclusive property of the customer. Floorfy receives only a narrow permission: the customer authorises it to process that content solely to provide the contracted services, which covers hosting, processing and editing. Floorfy separately states that it owns the intellectual property in the platform itself. For personal data inside that content the customer is the controller and Floorfy acts as processor under Article 28 GDPR, through the data processing agreement annexed to the terms. One reservation deserves attention: unless the customer objects in writing, Floorfy may cite the commercial relationship, including the customer's trade name and logo, for promotional purposes.

Reuse rights

Customers may reuse what they generate without asking permission. The terms place ownership of Client Content with the customer and limit Floorfy's own rights to delivering the service, so photographs, videos and tours can be published freely on portals, social networks and marketing campaigns. That is in fact the declared purpose of the product, and a branded watermark feature exists so output carries the agency's own identity. Two practical limits apply. Deleted content stays recoverable for thirty days only, and once an account is cancelled the content is kept for six months and then permanently removed, so anything an agency wants to keep must be exported before it leaves. Nothing in the terms or the privacy policy restricts commercial reuse of generated material, and nothing states that customer content feeds model training either way.
