GDPR overview
GDPR implementation is concrete and unusually thorough for a sole trader. The controller is named and established in Germany: Jan Hammer, Hammer Creations, Cleebronn, jan@3daistudio.com. The privacy policy is organised by legal basis under Article 6(1)(a), (b), (c) and (f), with a cookie consent tool and a reference to Section 25(1) TDDDG. Data subject rights under Articles 15 to 20, 7(3), 21 and 77 are listed explicitly. A Data Processing Agreement concluded under Article 28 GDPR is published, version 1.0 dated 28 February 2026, with annexes covering processing details, Article 32 security measures and sub-processors. A dated sub-processor list names each provider, its processing location and its transfer mechanism: EU-US Data Privacy Framework, Standard Contractual Clauses under decision (EU) 2021/914, or adequacy. The vendor states that it does not sell, rent or trade personal data.
Who owns the data?
The terms give you ownership of the output you generate, subject to any third-party rights embedded in it, and that licence is perpetual for assets created while a paid plan was in good standing. You also keep your prompts. In exchange, you grant 3D AI Studio a non-exclusive, royalty-free, worldwide and sublicensable licence to store, process, adapt, publish and display prompts and output in order to run, maintain and improve the service. Section 6.1 goes further and explicitly extends that right to training, improving and enhancing the vendor's AI technology. Aggregated, anonymised usage statistics belong entirely to the vendor, as do the underlying models, training data and algorithms.
Reuse rights
You may reuse generated models commercially without asking permission: games, apps, marketing material, product visualisation, client work and 3D printing are all covered, and the FAQ states that you retain full rights to your assets. Two limits matter. You may not use any output to train, develop or improve a machine-learning model, nor to build a product or service competing with the platform. And output may embed third-party or open-source components that carry their own licences, which the vendor does not warrant against. Anything uploaded to the public Community Library is separately licensed to other users, and removing it later does not undo downloads already made.
