GDPR overview
Adsby B.V. is established in the European Union, in Amsterdam, so it falls directly under the GDPR and needs no Article 27 representative. Its privacy notice, effective February 16, 2024, sets out the legal bases it relies on under the GDPR and UK GDPR (consent, performance of the contract, legal obligations, vital interests and legitimate interests) and lists the rights available in the EEA, the United Kingdom, Switzerland and Canada: access, rectification, erasure, restriction, portability, objection and freedom from automated decisions, plus withdrawal of consent at any time. Who owns the data?
Under the terms of service effective June 11, 2025, Adsby owns or licenses every intellectual property right in the platform, its content and its marks. Anything sent to the company as a question, suggestion, idea or piece of feedback becomes an assigned Submission that Adsby may use and circulate without limit, credit or payment. Section 22 states that Adsby stores the data you transmit in order to keep the service running and performs routine backups, yet you remain solely responsible for that data and waive any claim if it is lost or corrupted. No clause assigns Adsby ownership of your campaign data or of the ad copy generated for you. The privacy notice of February 16, 2024 has Adsby deciding how personal information is processed, placing it in the controller's seat.
Reuse rights
The privacy notice effective February 16, 2024 lists the purposes: delivering, improving and administering the service, communicating with users, security and fraud prevention, and legal compliance. Adsby collects registration details, log and usage data, device data and location inferred from IP address. It states that it processes no sensitive personal information and collects nothing from third parties, and its Termly disclosures record no sale or sharing of personal information in the CCPA sense. Sign-in can run through a Google account or a social account, in which case Adsby receives name, email address, friends list and profile picture. Google Analytics runs on the website with demographics, interests reporting and remarketing enabled, with opt-out links provided. Information received through Google APIs is handled under the Google API Services User Data Policy, Limited Use requirements included. Where the user gives consent, the company profile — brand name, business description, target audience and target location — is shared with third-party tools, among them AI models, to generate, manage and optimize ads. Nothing in the documentation states whether customer data feeds model training, and no training opt-out is offered.

Section 7 of the privacy notice states plainly that Adsby's servers are located in the United States, and that information may be transferred to, stored by and processed in the United States and in other countries, including in the facilities of the third parties with whom Adsby shares personal information. No choice of hosting region is offered and no European data center is announced. This sits at odds with the publisher's own establishment: Adsby B.V. is registered in Amsterdam, in the Netherlands, and its terms run under Dutch law. No transfer mechanism is named anywhere in the documentation, neither standard contractual clauses nor the EU-US Data Privacy Framework, which leaves the legal basis for the transfer undocumented.
