GDPR overview

Agentative never writes that it is GDPR compliant, but the privacy policy sets out the machinery. Four legal bases are named: performance of the contract, legitimate interest, consent and legal obligation. Data subject rights are listed under both the GDPR and the CCPA/CPRA, covering access, rectification, erasure, restriction and objection, and portability, exercised by email to support@agentative.ai. Personal data is hosted in the United States, with Standard Contractual Clauses cited for EU/EEA transfers. Cookies cover session, preferences and audience measurement, controlled through the browser. The minimum age is 13, or the local minimum. Two gaps deserve attention: no Article 27 EU representative is designated and no data protection officer is named. The policy also carries contradictory dates, showing an effective date of 11/7/2025 and a last update of 7/21/2026 in the body, against January 16, 2026 in a banner.

Who owns the data?

Under section 6.1 of the terms of service, the customer keeps all rights to and ownership of Customer Data, meaning everything uploaded, imported, or accessed on the customer's authorisation from connected third-party platforms. Agentative LLC states plainly that it claims no ownership. What the customer grants instead is a limited, non-exclusive licence, and it exists for one purpose only: allowing the vendor to operate the services the customer has switched on. Section 9.3 restates that the customer retains its rights on termination. In practice, ownership stays with the seller and the vendor holds a service-scoped permission, not a title.

Reuse rights

Because ownership stays with the customer, nothing in the terms restricts what a seller does with its own exports and records. On the vendor side, section 6.2 limits access, processing and storage to the services actually activated, plus operation, maintenance, security and improvement, analysis in aggregated or anonymised form, legal obligations and fraud prevention. Section 6.3 adds data minimisation: only the data scopes required by the features enabled. Section 6.6 rules out advertising use, building competing products and any resale. The privacy policy repeats that personal data is never sold and is not used for unrelated marketing without an explicit opt-in, and that data drawn from Meta, Google Ads and Amazon Ads is neither resold nor used to train proprietary models. Should you pick Agentative?
