GDPR overview

GDPR is addressed concretely rather than claimed as a badge. The privacy policy carries a dedicated "GDPR: Information for EEA Users" section listing access, rectification, restriction, objection, erasure and portability rights, and it names the legal bases relied on: consent for marketing, contract performance, and legitimate interests for fraud prevention and network security. A standalone Data Processing Addendum is published, in which Checksum acts as processor on documented instructions and incorporates the EU Controller-to-Processor and Processor-to-Processor Standard Contractual Clauses, with UK and Swiss addenda. Personal data is transferred to and stored in the United States, a country without an adequacy decision, covered by those clauses under Article 46. No Article 27 EU representative is named, and the trust centre lists only SOC 2 and HIPAA as compliance programmes.

Who owns the data?

The Master Subscription Agreement states that, as between the two parties, the customer owns all rights in the data it puts into the service. Checksum may use that data to operate the service and, in its own words, to build or improve its products and offerings. Checksum owns the service itself, including its machine learning, and states that its algorithms are engaged in continual machine learning whose results it owns outright. It may also keep aggregated or de-identified data indefinitely. Generated tests are the exception: they are plain Playwright code committed to the customer's repository and belong to the customer. All customer data is deleted thirty days after the contract ends.

Reuse rights

Customers can reuse the generated tests without asking permission. They are standard Playwright files delivered by pull request into the customer's own repository, so they can be run anywhere, edited freely and taken along if the customer leaves — the vendor's stated guarantee against lock-in. The service itself is far more restricted: the agreement forbids reselling, sublicensing, renting, reverse-engineering or creating derivative works of it, using it for benchmarking or competitive comparison, or using it to build a competing product. Checksum data may only be used in connection with the service. Retention summary
The privacy policy keeps personal information only for as long as the purpose of storage requires or the law permits, using the applicable statutory retention period as its criterion, after which data is routinely deleted unless still needed for a contract.
