GDPR overview
Conker claims compliance in as many words: We are compliant with FERPA, COPPA, GDPR and the Australian Privacy Act, in a privacy policy effective 24 February 2023. The detail runs deeper than the slogan. Legal grounds for processing EEA and UK data are listed one by one, and the six data subject rights are set out, with the caveat that a small fee may be charged for an access request. Requests go to support@conker.ai and are answered within thirty days. Publisher Mote Technologies, Inc. is certified under the EU-U.S. Data Privacy Framework and its UK extension, falls under FTC enforcement, and commits to cooperate with the EU data protection authorities panel and the UK ICO. Who owns the data?
Conker is explicit that it does not own what you put into it: We don't own the content you add to Conker, and the terms confirm the publisher claims no ownership of submissions. The nuance is in the licence attached to them. By submitting content you grant Conker, its affiliated companies and any necessary sublicensees permission to copy, distribute, transmit, publicly display and perform, reproduce, edit, translate and reformat that submission, and to publish your name alongside it, with no compensation. Reuse rights
Teachers keep the run of their own material: nothing in the terms restricts reusing, editing or redistributing a quiz you built, and quizzes are designed to leave the tool, exported to Google Forms or shared through Canvas LMS. On Conker's side the declared uses are operational: running the site and your account, delivering the service, processing purchases, sending service and marketing messages, and giving access to audio recordings. Conker also tracks which pages users visit and how shared quizzes and forms perform, to measure engagement and steer the product. Conker stores personal data with Amazon Web Services in Oregon, United States, and names no other location: there is no EU region and no choice of jurisdiction. The domain itself resolves to an AWS address in the United States. Billing is handled separately, with contact and payment details held in Chargebee's Level 1 compliant database. Declared protections are the SSL protocol and password protection across all storage systems, encryption for sensitive data such as card numbers in transit, and physical, electronic and procedural measures, with staff trained on the applicable privacy laws. A breach policy is published: Conker commits to assess quickly and, where a breach has occurred or is reasonably likely, to notify the date, the types of data affected, the nature and likely consequences, the steps being taken and a named contact, with parallel notice by email and telephone to a school district where one is involved.
