GDPR overview
Section 3 of the terms is headed 'Data Privacy (GDPR/CCPA)' and states that Filmpitch implements reasonable technical and organisational measures and complies with the GDPR for European users and the CCPA for California residents. The rights listed are access and portability, correction, deletion, restriction or objection, plus opt-out of sale for Californians. All of them are exercised through a single address, info@filmpitch.ai, and requests are said to be handled within the deadlines set by both laws; the privacy policy adds that third-party partners must process data in line with the GDPR and CCPA. What is missing is substantial: no Article 27 EU representative, no named data protection officer, no data processing agreement published or offered, no list of sub-processors and no declared hosting country or region. Who owns the data?
Section 7 of the terms assigns to you any rights Filmpitch may hold in the AI output once it has been generated and delivered, for personal or commercial use.
