GDPR overview

Fluents never claims GDPR compliance in so many words, but the privacy policy of 21 April 2025 carries most of the substance. A dedicated Europe section covers the EEA, Switzerland and the United Kingdom, names the legal bases relied on, consent, performance of a contract, legitimate interest and legal obligation, and confirms that transfers to third parties are safeguarded by European Commission-approved standard contractual clauses, with further measures where appropriate. The rights listed are complete: access, correction, updating, erasure, objection, restriction, portability, withdrawal of consent and complaint to a supervisory authority, all exercised through support@fluents.ai. A DPA is available, cited alongside a BAA among the Enterprise commitments. Two gaps stand out: no Article 27 EU representative is named and no data protection officer is designated.

Who owns the data?

Under the terms of service you keep what you bring and what comes out: you retain ownership of your Input and own all Outputs created through the service, to the fullest extent the law allows. The platform itself is not yours. Trademarks, software, know-how and trade secrets stay with Fluents.ai, Inc. as what the terms call Fluents IP, and nothing grants you a licence over them. Ownership is also not exclusivity: Fluents may use your Content to provide, maintain, develop and improve the service, to comply with the law and to enforce its terms and policies, and it may refuse or act on any content at its sole discretion. You stay responsible for everything your users say through the service.

Reuse rights

You can reuse your own material without asking Fluents for anything. Because the terms grant you ownership of the Outputs, transcripts, recordings, summaries and call dispositions can be pushed into your CRM, your warehouse or your BI tools and used commercially, and the platform is built to do exactly that. The constraints sit on what you feed in rather than on what you do afterwards: you warrant that your content is lawful and infringes nobody's rights, and you may not transmit financial, medical or sensitive personal data through the service. Fluents runs a parallel licence over the same material, using it to operate and improve the platform and disclosing it to service providers, which the privacy policy says may include third-party AI services. Payment details are handled by Stripe. One carve-out is explicit and one-way: Google Workspace data is never used to develop, improve or train AI models and is not shared with third-party AI tools, unless you configure that sharing yourself.
