Formshare is an AI form builder published by the British company Websecurify Limited and presented on its own site as Formshare By ChatBotKit. The terms of service do contain generic billing clauses, including payment in US dollars, a 1.5% monthly late charge and fourteen days' notice on price increases, and refer to a free tier with credits whose benefit may not be stacked across multiple accounts. Those clauses match no offer visible on the site and should be read as contractual boilerplate rather than as evidence of a hidden paid plan.

GDPR overview
Compliance is claimed explicitly, but under the UK GDPR and the Data Protection Act 2018 rather than the European Union's GDPR. A data protection officer is named and reachable: Petko Petkov, pdp@websecurify.com, 86-90 Paul Street, London EC2A 4NE. The supervisory authority cited is the UK Information Commissioner's Office. A Data Processing Addendum is available on request at legals@websecurify.com for customers governed by the GDPR or the CCPA. Access requests are free, subject to identity verification, and may be refused when manifestly unfounded. No EU representative under Article 27 is designated. One grey area remains on dates: the privacy policy is headed 04 September 2024 while its own section 8 states that this version is dated 22 April 2021. The terms were last modified on 29 August 2024.
Who owns the data?
The terms are explicit: you own all Input you submit, and FormShare assigns to you all its right, title and interest in the Output. The forms you build and the answers you collect are yours. In return, the publisher reserves the right to use your Content to provide and maintain the service, to comply with the law and to enforce its policies, and you remain responsible for that Content and its legal compliance. For the personal data attached to your account, Websecurify Limited acts as data controller rather than processor. The privacy policy adds that personal data may be transferred to an acquirer in the event of a sale or acquisition of the business.
Reuse rights
On your side, reuse is unrestricted: since the Output is assigned to you, the forms, the questions and the collected answers can be published, exported and fed into other tools without asking permission. The reverse direction is less open. Section 3(c) of the terms lets FormShare use your Content by default to develop and improve the services, and opting out requires an email to legals@websecurify.com quoting your organization ID rather than a switch in the interface; the publisher warns that opting out may make the service less relevant for a specific use case. The privacy policy relies on consent, contractual necessity, legal obligation and legitimate interest, states that no special-category or criminal-offence data is collected, and sends marketing only on explicit opt-in. Sharing with third parties is limited to a change of control, a sale, a technology licence or a legal obligation.
Data retention & training
Hosting summary
The site declares nothing about hosting. Neither the privacy policy nor the terms name a hosting country, a region, a data center or a cloud provider, and the privacy policy mentions possible subcontractors without publishing any list of them. Public information therefore does not allow a data residency requirement to be verified. The only jurisdictional anchor is corporate: Websecurify Limited is a UK company, named as data controller, claiming compliance with the UK GDPR and the Data Protection Act 2018, with the Information Commissioner's Office as supervisory authority. One element sits outside any statement by the publisher: the domain resolves to 216.150.16.193, an address geolocated in the United States on AS16509 (Amazon.com Inc.). That is a network observation, not a declaration by the publisher, and the address may well be a CDN or anycast node; it says nothing about where form responses are actually stored.
