Fudge is a Shopify App Store application (handle fudge-agent) that behaves as an AI agent inside the store itself. The site positions it as an AI-powered Shopify store editor and page builder, and its comparison pages call it the first native AI agent for Shopify. You describe what you want in ordinary language; Fudge writes native Shopify theme code — readable, editable Liquid, JavaScript and CSS added straight to the theme, with no iframes, no external rendering layer and no proxy setup. The privacy policy effective 7 January 2026 sets out an explicit GDPR posture without ever claiming compliance in so many words. Fudge It, Inc. names itself data controller; the legal bases are contract performance, legitimate interests, consent where required and legal obligation, with consent withdrawable at any time. Rights of access, rectification, erasure, objection, restriction and portability are listed and exercised at privacy@fudge.ai, subject to possible identity verification; additional rights are acknowledged for residents of certain US states, California and Virginia among them. A DPA is offered on request. Three gaps stand out: no Article 27 EU representative is named although the company is US-based and serves European customers, the subprocessor list is only available on request rather than published, and no security certification such as SOC 2 or ISO 27001 is claimed. Governing law and jurisdiction are Delaware.

Who owns the data?

Under the terms of service effective 7 January 2026, you keep every right in the content you upload or generate (“User Content”). Submitting it grants Fudge It, Inc. a worldwide, royalty-free license to host, store, reproduce, modify and display that content only as far as necessary to provide the Services, and you warrant that you hold the necessary rights. The privacy policy of the same date makes Fudge It, Inc. the data controller unless agreed otherwise in writing, treats content, configuration, code and prompts as Customer Content that may contain personal data, and states that Fudge does not sell personal information. Pages you publish live in your own Shopify theme and stay there after uninstall.

The privacy policy effective 7 January 2026 lists the declared purposes: providing and maintaining the Services, authenticating users, generating, personalizing and improving AI-assisted output, processing payments, monitoring and securing the platform, communicating with you, and meeting legal obligations. Customer Content is “processed solely to provide and improve the Services”, aggregated or de-identified usage data is used to improve system reliability, performance and product features, and automated processing is stated to produce no legal or similarly significant effect without human involvement. Data comes both from what you supply — name, email, company, credentials, billing details, support exchanges — and from what is collected automatically: IP address, device, browser and operating-system identifiers, usage, logs and diagnostics. It is shared with service providers and subprocessors covering hosting, analytics, payments and support, with professional advisers, and with authorities where required. On the output side you are free to reuse what Fudge produces without asking: the generated code lands in your own Shopify theme, stays yours and keeps working after the app is removed. The blind spot is model training. Across the pages collected, the policy never says whether Customer Content is or is not used to train AI models, and no training opt-out is documented — the only “opt out” it offers concerns marketing communications. Cookies are split into essential, analytics and performance, and preference categories, with consent collected where the law requires it.

The privacy policy effective 7 January 2026 is unambiguous on jurisdiction: “All user and customer data is stored in the United States, including data relating to EU customers.” The same section notes that the infrastructure operates globally and that processing may rely on infrastructure located in multiple regions for performance and reliability, without ever naming those regions. Which e-commerce platform does Fudge work with?

Do I need to code, or to know Liquid?

Can Fudge break my live store?
