GDPR overview

The word GDPR never appears on the site. The regulation surfaces only under its formal title, Regulation (EU) 2016/679, in the Terms' definition of Personal Data. The privacy policy of 08/03/2024 nonetheless carries a dedicated section, Additional Information for EEA and UK Residents. It names legal bases, performance of the contract, legitimate interests, legal obligation and consent, and rights: access and a copy (a modest fee may be charged), rectification, portability, erasure, objection, restriction and complaint to a supervisory authority. Requests go to data-requests@gencraft.com, and a Privacy Officer is reachable at privacy@gencraft.com. Who owns the data?

Ownership splits by tier. The FAQ tells Starter and Pro subscribers that "you own the images you generate to the extent allowed by law, and you are free to use them commercially." Non-subscribers get only a Creative Commons Noncommercial 4.0 Attribution International licence. Customized Features never transfer, custom models included, even one trained on your own pictures: "You acknowledge and agree that Customized Features shall be the sole and exclusive property of the Company." That is a limited licence back to you, not a work made for hire. You stay solely responsible for your User Content, Feedback you send is assigned outright, and anything posted publicly is treated as non-confidential.

Reuse rights

The privacy policy lists what Gencraft collects: contact details, demographic data, payment information, the content you submit (prompts, photos, videos), transaction records, device identifiers, IP address and clickstream. It comes from three places, what you provide, automatic collection through cookies, pixels, SDKs and tags, and third parties including social platforms. The stated purposes are running and improving the service, communicating with users, marketing and advertising, and protecting the company's rights; Google Analytics and Firebase are named as analytics providers. Data is shared with affiliates and subsidiaries, service providers for payment, cloud and analytics, social platforms, authorities, and any acquirer in a corporate transaction. The policy states plainly that "Gencraft is not in the business of selling your information" and denies any sale under United States state privacy laws. Images uploaded to train a custom model are used for that model alone and are neither shared nor reused for another purpose. The service runs from the United States. The privacy policy states that "the Services are operated from the United States. Information may be processed and stored in the United States or other countries", and those other countries are never named. Transfers out of the EEA, the United Kingdom and Switzerland are covered by standard contractual clauses approved by the European Commission. No hosting country or region is offered as a choice: there is no data-residency option, and no certification such as SOC 2 or ISO 27001 is claimed anywhere on the site.
