GDPR overview

GDPR implementation is concrete and documented. A public DPA (v2026.02.28) covers the EU GDPR, the UK GDPR, the Swiss federal data protection act and the CCPA/CPRA. Transfers from the EEA, the UK and Switzerland rely on Standard Contractual Clauses, the UK Addendum or other approved mechanisms. The DPA provides for authorized subprocessors bound by substantially similar written terms with a customer right to object, notification of confirmed security incidents without undue delay, assistance with data subject requests, DPIAs and prior consultations, and audit rights satisfied notably through SOC 2 reports. Who owns the data?

Under the Terms of Service (v2026.02.28), you keep ownership of your Customer Materials: data, content, branding, recipient information, campaign materials, artwork, messages, addresses and instructions. Giftpack receives a limited, non-exclusive, worldwide license to host, process, reproduce, transmit, display and disclose them, only as far as reasonably necessary to provide, support, secure and improve the services. Feedback you send may be reused without obligation towards you. You remain free to reuse your own Customer Materials as you wish; the license you grant runs one way, towards Giftpack, and does not restrict what you do with your own data.
