GDPR overview

There is no GDPR implementation to report. Across the homepage, the pricing page, the terms of service and the privacy policy, the words GDPR, CCPA, data protection officer and right to erasure never appear once. No Article 27 representative in the European Union is named, no data processing agreement is offered, no subprocessor list is published, and no postal address is given for the company. The privacy policy itself is dated 14 February 2023 and stops abruptly after the section describing how personal data is used: it carries no section on data subject rights, retention periods, international transfers or a privacy contact. The terms place the agreement under the law of the United Arab Emirates, Dubai, with arbitration seated in Dubai. Who owns the data?

The terms state that you own the assets you create, to the extent possible under current law, but with two exceptions. If you are not a paying member and have not tokenised your output as an NFT, you do not own it: Orbofi grants you a Creative Commons BY-NC 4.0 licence instead. And if you use the service on behalf of an employer with more than 1,000,000 USD of yearly revenue, a Pro membership is required for every individual before that ownership applies. In every case you grant Orbofi Studios a perpetual, worldwide, non-exclusive, sublicensable, royalty-free and irrevocable licence over the text and image prompts you enter and the assets produced, and that licence survives termination of the agreement.

Reuse runs in both directions. By default your images and prompts are publicly viewable and remixable by other members, and the terms describe Orbofi as an open community on exactly that basis; buying a Pro plan or tokenising an asset as an NFT is what lets you bypass those public sharing defaults. You may therefore reuse what other people have posted publicly, under the same rules. Where you are not a paid member, your own assets are covered by the Creative Commons BY-NC 4.0 licence, which allows reuse with attribution but forbids commercial use.
