GDPR overview
Compliance is claimed explicitly, with a GDPR badge on the home page and a dedicated Trust page, and the privacy policy in force on 26 June 2026 is detailed. It publishes a legal-basis table (contract performance, legitimate interest, consent), lists the full set of rights including access, rectification, erasure, restriction, objection, portability and withdrawal of consent, and keeps the right to object expressly open where legitimate interest is invoked, model improvement included. Who owns the data?
Ownership splits in an unusual way. Under clause 5.3 you keep all rights to your Input, meaning the photos, sketches and prompts you upload, and remain solely responsible for them, while clause 5.4 grants PAINTITAI LTD a worldwide, non-exclusive, royalty-free, transferable and sub-licensable licence over that Input. Clause 5.5 then assigns all rights in the Output exclusively to the publisher, which may use, reproduce and publish the generated images at its discretion, including in marketing, portfolio, gallery, social media and investor materials. A commercial-use licence over your renders comes only with the Pro plan. Input and Output, chat history included, may be reviewed by automated systems and, where necessary, by a human.
Reuse rights
You cannot reuse a render freely by default: commercial use is licensed only from the Pro plan upward, and lower tiers deliver watermarked images. On the publisher's side, clause 5.4 allows Input to be used to deliver the service, fight fraud, test and develop products, models and features, including training and fine-tuning internal AI models, produce aggregated and anonymised analytics, and measure and improve marketing, lookalike audiences included. Raw Input is not sold to third parties, but processing may pass through OpenAI, Google (Gemini), Anthropic (Claude), Perplexity AI and similar providers; where available and reasonable, those API services are configured to limit the provider's use of the data for training its own foundation models. Employees and contractors access content on a strict need-to-know basis under confidentiality obligations, and data is aggregated, anonymised or pseudonymised where feasible before analytical or training use. Private Mode, available on paid plans, keeps photos, chats and designs out of the public galleries but, in the publisher's own words, does not make your data completely invisible to Paintit.ai. No product setting excludes your content from training; the only lever is the GDPR right to object to legitimate-interest processing. Website tracking relies on Google Tag Manager, GA4 and Microsoft Clarity, heatmaps and session recordings included, with marketing tags for Meta, TikTok, Pinterest and Google Ads.
