GDPR overview
Playform never states that it is GDPR compliant. What the privacy policy does contain is a dedicated section, Legal Basis for Processing Under GDPR, listing four bases: performance of a contract, consent where required, legitimate interests in providing and improving the service, and compliance with legal obligations. It opens with the conditional wording to the extent GDPR applies. The same policy declares itself written for the collection of information from United States residents, and warns that data is transferred to and processed in the United States. It promises appropriate safeguards for cross-border transfers, such as standard contractual clauses, where the law requires them. Who owns the data?
Under the terms, you keep every intellectual property right you already hold in the images you upload, and you own the intellectual property in whatever the AI generates for you, as between Playform and yourself. Commercial rights are full: you may sell, publish and distribute your outputs without restriction from Playform, and crediting the platform is optional. The licence you grant back is deliberately narrow. Playform may copy, analyse and use your content for debugging, testing, service improvement and support only, and the terms state explicitly that improving the service excludes training or fine-tuning general-purpose image generation models. Legality, appropriateness and non-infringement remain your responsibility.
Reuse rights
You may reuse everything you generate without asking anyone. Outputs can be sold, published and distributed for personal or commercial projects, with no credit owed to Playform and no further licence to request. The practical limit is not the platform's permission but third-party rights: you are solely responsible for the copyright status of the source images you upload and for judging whether an output infringes someone. On Playform's side, personal data is collected at sign-up (full name, email address) and at purchase (name, physical address, payment details), alongside technical data gathered through cookies and Google Analytics. The policy states that personal information is never sold, rented or leased, and is shared only with explicit opt-in consent, under legal compulsion, or with contracted providers such as billing, who are barred from using it for anything else. Playform's privacy policy states that its servers are located in the United States, and that visitors from outside the country should expect their information to be transferred to, stored and processed there. A second passage widens this: personal data may be processed in the United States or in other jurisdictions where Playform or its service providers maintain facilities, none of which are named. Where the law requires it, the company says it applies appropriate safeguards for cross-border transfers, such as standard contractual clauses or other permitted mechanisms. No alternative hosting region is offered and no data residency option exists, so there is no way to keep content inside the European Union. No subprocessor list is published, which leaves the identity of those facilities undisclosed. For reference rather than as a vendor statement, DNS resolution for the domain returns 75.2.60.5, geolocated in the United States on Amazon infrastructure and flagged as an anycast node; that is an infrastructure observation, not a declaration by Playform.
