GDPR overview
GDPR is addressed, but only partly. The privacy policy carries a dedicated section, "Your data protection rights under GDPR rules", granting EU residents access, rectification, erasure, objection, restriction and portability, with hello@sellmethispen.ai named as the channel for exercising them. A separate block covers CCPA and CPRA through help@sellmethispen.ai. Beyond that, implementation is thin. The company never states in plain words that it is GDPR compliant; the only explicit compliance claim on the site concerns its subprocessor OpenAI. No Data Processing Agreement is published or offered, no formal subprocessor list exists, and no EU representative is designated under Article 27. The policy carries no effective date, and its compliance framing is Canadian, naming PIPEDA.
Who owns the data?
The terms are unambiguous on ownership: user content belongs to the user. SellMeThisPen Software Inc. states that you own your Input and your Output, and it makes no copyright claim over either. What the publisher takes is a licence to host and use that content on its platform in order to operate the service. Two reservations qualify this. The company keeps absolute discretion to remove, screen or edit user content at any time and without notice, and it may disclose Input or Output to law enforcement, government authorities or a court where content is alleged to be unlawful. What the platform stores are call transcripts, not call recordings.
Reuse rights
Because users keep ownership of their Input and Output, they may reuse what they generate for any lawful purpose without asking permission, provided they comply with the AI Product Terms and accept that the use is at their own risk. Those terms restrict what may be generated rather than what may be reused: no source code, no medical, legal or financial advice, no political or electoral content, no fully automated decision-making, and nothing designed to mislead a reader into believing AI output is human-written. Anyone sharing output publicly must review each result manually, attribute it to themselves or their company, and label it unmistakably as AI-generated. Sensitive personal data must never be entered as Input, and the publisher may cap how many outputs an account can create.
Data retention & training
Hosting summary
Testing, staging and production environments run on Microsoft Azure, which the publisher describes as compliant with SOC 1, SOC 2, SOC 3, ISO 27001 and HIPAA. No Azure region is named and no data residency option is offered. On jurisdiction the documents disagree: the privacy policy states that data, including personal data, is transferred to and processed in Canada for users located outside Canada, yet the same policy also says personal information is stored on company data centre servers in whatever country they may be located. Governing law is that of Ontario and the federal laws of Canada. Protection measures are stated clearly: AES-256 encryption at rest covering call transcripts, TLS 1.2 in transit, access controls, encrypted backups, and access to customer data restricted to authorised employees on a need-to-know basis. Payment data is isolated with Stripe on PCI-compliant servers and never reaches the publisher's own systems. Inputs are shared with third-party providers, including OpenAI, LLC in the United States.
