GDPR overview

Sembly AI states plainly across its site that it is GDPR compliant, and its privacy policy, last modified in July 2026, backs that up with concrete detail. It sets out five lawful bases: contract performance, legitimate interests, legal obligation, consent, and customer instructions where Sembly acts as processor. It grants all users, wherever they live, the rights to access, copy, rectify, erase, restrict, object, port their data and opt out of model training, and confirms no automated decision-making. EU customers can have their data held inside the EEA. The company is certified under the EU-U.S. Data Privacy Framework and its UK extension, and answers to the FTC. Two gaps remain: no Article 27 EU representative and no data protection officer is named, and all requests route through a single support address.

Who owns the data?

The terms of service are explicit: you, or your organisation, own every recording, transcript and report the service produces, together with the intellectual property rights in them. Sembly AI undertakes not to disclose that content without your written consent, subject to the usual carve-outs for information that was already public or already known to it. In exchange you grant Sembly AI a royalty-free, irrevocable and transferable licence to use the same material to run the service and for its own internal purposes, research and product improvement included. Aggregated, de-identified data falls outside that ownership: Sembly AI may copy, modify, publish, sell and distribute it, provided nothing personal or confidential surfaces.

Reuse rights

Because you own the recordings, transcripts and reports outright, you may reuse, edit, export and share them without asking Sembly AI for permission, and you may delete them at will. Users can remove individual audio, video and whole meetings; deleting an account removes every meeting attached to it. The licence you grant runs the other way, and it is broader than it first appears. The terms of service let Sembly AI use your recordings, transcripts and reports for internal business purposes, expressly including artificial intelligence development and training. The privacy policy, dated July 2026, states almost the opposite, that the models it uses do not learn from your usage, and the marketing pages settle somewhere in between: content from Enterprise customers is never used for model training, while every other plan relies on an opt-out setting the customer has to switch on. Where content is used to improve the service, Sembly AI says it is anonymised first and personally identifiable information redacted. Anyone who cares about this point should read all three sources rather than any one of them.

Data retention & training

Retention summary
Retention is largely in your hands. Users and workspace administrators choose how long meeting content is kept and can set rules that delete it automatically after a chosen period. Account data is held while the account is active and removed after deletion, unless legal, security, audit or contractual reasons require otherwise. Deleted meeting content leaves production systems immediately but can remain in backups for up to fourteen days. Support records, billing and tax records, and security and audit logs each follow their own periods, the financial ones set by law. Marketing preferences are kept until you unsubscribe or object. Immediate deletion of everything is possible only after the account itself is deleted, on request to support. Once a period expires, data is deleted, anonymised or aggregated.

Hosting summary

Sembly AI lets you choose a US or EU hosting region at signup. All meeting data - recordings, transcripts, AI-generated documents and metadata - is then processed and stored inside that region. For customers in the European Union, personal data may be held exclusively within the European Economic Area, in support of GDPR compliance, and transfers outside the EEA occur only where legally permitted. The company qualifies this: some user data may still be processed and transferred while not being stored in US data centres. Enterprise buyers get three deployment models: Tenant IDS, an isolated datastore inside the Sembly Secure Cloud; Tenant PDS, a fully isolated private datastore with a limited choice of alternative geographic regions on Google Cloud Platform; and Sembly XP, a private cloud with dedicated processing and storage in a region of your choice and optional VPN-only access.
